1. Acceptance of Terms
By creating an account, accessing, or using Kaymo (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not access or use the Service.
2. Description of the Service
Kaymo provides a web-based wellness and educational platform that allows users to upload and visualize personal imaging data (such as MRI or CT scans) for exploration and understanding.
Important Notice: Kaymo is not a medical or diagnostic tool. The Service and any information provided are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and should not be used as a substitute for professional medical advice.
3. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use Kaymo. By registering, you represent that you meet these requirements.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@kaymo.me if you suspect unauthorized access.
5. User Content
5.1 Uploads
You may upload personal data, including medical imaging files (“User Content”). By uploading, you grant Kaymo a non-exclusive, worldwide, royalty-free, revocable license to process, analyze, and internally use your data for:
- Providing the Service to you
- Improving the Service and its performance
- Conducting internal research and model training
Kaymo will not share, sell, or publicly distribute your identifiable data to third parties.
5.2 Data Integrity
You represent that you have the right to upload and use the content, and that it does not violate applicable laws or third-party rights.
6. Internal Research and Model Training
Kaymo may process uploaded data in de-identified form for internal purposes such as:
- Product development and algorithm improvement
- Performance benchmarking
- Aggregated usage analytics
Kaymo will not make such data publicly available or share it externally.
7. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer or interfere with the platform
- Upload malicious code or data that infringes intellectual property rights
- Misrepresent your identity or ownership of uploaded content
8. Intellectual Property
Kaymo retains all rights, title, and interest in its technology, algorithms, and interfaces. Nothing in these Terms transfers any ownership of Kaymo’s intellectual property to you.
9. Disclaimers
Kaymo provides the Service “as is” and “as available” without warranties of any kind, express or implied. Kaymo disclaims all warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Kaymo does not warrant that the Service will be error-free, secure, or uninterrupted.
10. Limitation of Liability
To the fullest extent permitted by law, Kaymo shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or relating to your use of the Service. Kaymo’s total liability for any claim shall not exceed the amount you paid (if any) for access to the Service during the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Kaymo, its officers, employees, and affiliates from any claim or demand arising from your use of the Service, your User Content, or your violation of these Terms.
12. Termination
You may stop using the Service at any time. Kaymo may suspend or terminate your access if you breach these Terms or misuse the platform. Upon termination, your account may be deleted, and Kaymo may retain de-identified data for internal research and legal compliance.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising under these Terms.
14. Changes to These Terms
Kaymo may update these Terms from time to time. The updated version will be posted on kaymo.me with a revised “Last Updated” date. Continued use after updates constitutes acceptance of the revised Terms.
